1. Acceptance of Terms & Eligibility

By accessing, browsing, registering for, or using the Gova AI website (https://govaai.xyz), application programming interfaces, or related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

Gova AI is currently operated as an early-stage software project under its founding team. You must be at least 18 years of age (or have reached the legal age of majority in your jurisdiction) and legally capable of entering into binding contracts to register an account.

2. Account Creation, Security & Email Verification

• Account Accuracy: When creating an account, you agree to provide truthful and complete information. You may not impersonate others or use email addresses you do not own.
• Credential Security: You are responsible for safeguarding your login credentials. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
• Verification Links: To prevent fraudulent registrations and protect platform quotas, we issue email verification links. Certain features may require confirmed email verification.

3. Acceptable Use & Prohibited Conduct

You agree to use Gova AI solely for lawful travel planning and discovery purposes. You agree NOT to:

• Attempt to scrape, harvest, spider, or systematically extract data or catalogs without prior written consent.
• Circumvent or tamper with rate limits, tier generation limits, booster credits, or payment verification routines.
• Submit abusive, automated, or synthetic request floods intended to degrade infrastructure or cause unreasonable API expenditure.
• Reverse engineer, decompile, or extract the underlying algorithms of our routing, pricing, or AI synthesizers.
• Use the Platform to transmit malware, phishing campaigns, or fraudulent travel solicitations.

4. AI-Generated Travel Planning & Limitations

Gova AI utilizes multi-model artificial intelligence APIs (including Google Gemini, OpenAI, and xAI Grok) alongside a deterministic heuristics engine to generate travel itineraries, landmark recommendations, activity pacing, and budget estimates:

• Advisory and Planning Tool Only: Generated itineraries are automated suggestions provided strictly for planning and inspiration. They do not constitute guaranteed travel bookings, endorsed travel packages, or professional travel agency representation.
• No Guaranteed Accuracy: While we strive for realistic recommendations, artificial intelligence outputs may occasionally contain inaccuracies, out-of-date timings, temporary closures, or route suggestions that do not reflect local road conditions or strikes.
• No Booking Fulfillment: Gova AI does not itself operate hotels, issue airline tickets, conduct guided tours, or provide travel insurance. We do not process travel reservations on your behalf.

5. Budgets, Tariffs & Independent Traveler Responsibility

All currency figures, hotel price ranges, local transit fares (bus, taxi, scooter, ferry), monument ticket prices, and daily meal estimates displayed across Gova AI are benchmark estimates:

• Actual on-the-ground expenses fluctuate based on peak holiday seasons, surge pricing, fuel adjustments, inflation, and vendor rate changes.
• Your Responsibility: You are solely responsible for independently confirming:
  • Flight, train, bus, and ferry schedules and ticket availability.
  • Hotel reservation validity, security deposits, and check-in policies.
  • Monument, museum, and attraction opening hours, weekly closures, and ticket booking requirements.
  • Passport validity, tourist visas, permit requirements, and mandatory immunizations.
  • Local weather alerts, governmental travel advisories, and personal safety conditions.

6. Partner Listings & Third-Party Travel Businesses

Gova AI displays an interactive directory of independent hotels, homestays, licensed guides, and tour operators (“Partners”):

• Independent Third Parties: Listed partners are entirely independent third parties. Gova AI is not an employer, co-venturer, agent, or guarantor of any listed partner.
• Free vs. Promoted Listings: Free listings appear in destination directories. Partners who purchase “Promoted” or “Verified Partner” tiers receive highlighted visual badges, priority search positioning, or featured card status.
• Meaning of Verification Badge: The “Verified Partner” badge indicates that the business submitted commercial details and active contact channels reviewed during administrative onboarding. It does NOT constitute a warranty of quality, safety guarantee, or insurance coverage by Gova AI.
• Direct Bookings: When you contact or book with a partner via WhatsApp, phone, or external links, the resulting transaction is contracted exclusively between you and that partner.

7. Subscriptions, Usage Quotas, Credits & Billing

• Plan Catalog: Paid tiers (Yatri Pro, Royal Expedition, and Booster Packs) provide defined AI generation allowances as documented in our pricing catalog.
• Quota Limits: Free users receive 2 AI trips/month. Pro subscribers receive 25 AI trips/month. Once exhausted, additional generation requires a Booster Pack or waiting for the calendar month reset.
• Cancellation: You can cancel recurring subscriptions at any time via your user dashboard. Cancellation prevents future billing, and Pro access continues through the paid-through date.
• Refunds: Detailed billing, dispute, and refund procedures are governed by our separate Cancellation & Refund Policy.

8. Intellectual Property Rights

The Gova AI platform, codebase, brand name, logo, custom user interfaces, visual assets, and curated destination editorial content are protected by copyright and intellectual property laws.

Permitted Traveler Use: You are granted a personal, revocable, non-exclusive license to view, customize, and download your generated itineraries and printable PDF dossiers for personal, non-commercial travel planning.

9. Service Availability & Platform Modifications

We continually enhance our features. We reserve the right to modify, suspend, or discontinue any aspect of the platform with or without notice, including specific AI models, directory listings, or destination guides. We do not guarantee uninterrupted or error-free uptime.

10. Suspension & Termination for Cause

We reserve the right to suspend or terminate accounts without prior notice if we reasonably suspect:

• Breach of these Terms or acceptable use policies.
• Payment fraud, unauthorized chargebacks, or tampering with pricing routines.
• Abuse of AI generation APIs or automated scraping attempts.

11. Limitation of Liability

To the maximum extent permitted under applicable law, Gova AI and its operators, founders, developers, and contractors shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of profits, data, or travel arrangements arising out of or related to:

• Your use of or inability to access the Platform.
• Any inaccuracy, omission, or error in AI-generated travel itineraries or budget estimates.
• Travel disruptions, delays, cancellations, weather events, or road conditions.
• Actions, defaults, hygiene, safety, or quality of third-party hotels, tour guides, or travel businesses.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded under applicable consumer protection legislation.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. In the event of any controversy, claim, or dispute arising out of or relating to these Terms, the parties agree to first attempt informal resolution in good faith by contacting [email protected]. Any unresolved dispute shall be subject to the jurisdiction of competent courts in India.
